Acceptable Use Policy

This acceptable use policy applies to the products, services, and technologies (the “Products”) that Electro Battery Inc. provides. It applies under any active agreement.  It’s designed to protect us, our customers, and the general Internet community from unethical, irresponsible, and illegal activity.

Electro Battery Inc. customers found engaging in activities prohibited by this acceptable use policy can be liable for service suspension and account termination. In extreme cases, we may be legally obliged to report such customers to the relevant authorities.

Fair use

We provide our facilities with the assumption your use will be “business as usual”, as per our offer schedule. If your use is considered to be excessive, then additional fees may be charged, or capacity may be restricted.

We oppose abuse, discrimination, rights violations, and harmful actions, and expect customers and end-users to use our Products responsibly.

Customer accountability

We require our customers to take responsibility for their own conduct. They must also be accountable for the behavior of anyone they authorize to use our Products. This obligation still applies if someone uses our Products without permission. It may happen if the customer does not keep reasonable security protections in place.

By accepting our Products, customers agree to follow this policy for themselves and their end users. Complaints about customer actions, or actions by their end users, will be sent to the account’s nominated contact.

If a customer breaks our acceptable use policy, we may take action.

The same applies if the customer’s end user breaks the policy.

It also applies to anyone else who uses our Products through the customer. We may terminate Products tied to an offending account or the account itself, take appropriate remedial or preventive action, and do so without notice.

To the extent allowed by law, we will not give credits for service interruptions. These interruptions must be caused by violating our acceptable use policy.

Prohibited activity
Copyright infringement and access to unauthorized material

Our Products must not be used to transmit, distribute or store any material in violation of any applicable law. This includes, but is not limited to, material protected by copyright, trademark, trade secrets, or other intellectual property rights. Do not use such material without proper authorization. This also includes material that is obscene or defamatory. It also includes illegal threats or material that violates export control laws.

Customers are responsible for everything they input, upload, share, send, create, or publish on our Products. They must have legal permission to use any included works.

SPAM and unauthorized message activity

Our Products must not be used to send unsolicited bulk or commercial messages that break your local laws (“spam”). This includes sending spam. It also includes soliciting customers from spam sent by other service providers. It also includes collecting replies to spam sent by other service providers.

Our Products must not be used to run unconfirmed mailing lists or telephone number lists (“messaging lists”).

This includes adding email addresses or phone numbers to a messaging list without the owner’s permission.

It includes similar actions and stores added emails and phone numbers.

All messaging lists run on or hosted by our Products must be “confirmed opt-in”. Verification that the address or phone number owner gave clear permission must be kept. Keep it for as long as the messaging list exists.

We prohibit the use of email lists, telephone number lists or databases purchased from third parties intended for spam or unconfirmed messaging list purposes on our Products.

This policy covers spam and unauthorized messages sent using our Products. It also covers messages sent from any network by the customer. This includes messages sent by anyone on the customer’s behalf. It applies if the message directly or indirectly refers the recipient to a site hosted through our Products.

Unethical, exploitative, and malicious activity

Our Products may not be used to advertise, transmit, or provide any software, program, product, or service intended to violate this acceptable use policy or another provider’s policy. Prohibited activities include spam, network sniffing, pinging, packet spoofing, flooding, mail-bombing, and denial-of-service attacks.

Our Products must not be used to access accounts or electronic resources you don’t own or aren’t authorized to use, including hacking, cracking, or phreaking.

Do not use our Products to intentionally or recklessly introduce viruses or malicious code into our Products or systems.

Our Products may not be used to harass any individual or group. Harassment includes denial-of-service attacks, hate speech, and promoting racial or ethnic intolerance, as well as threats, abuse, rights violations, or discrimination of any kind.

Other activities considered unethical, exploitative, and malicious include:

Obtaining (or attempting to obtain) services from us with the intent to avoid payment;
Using our facilities to obtain (or attempt to obtain) services from another provider with the intent to avoid payment;
Unauthorized access, alteration, or destruction of customer or end-user information—and any attempts to do so by any method or device—are prohibited, as is using our facilities to disrupt others’ network access

Do not publish or share any content or links that promote or depict violence, include child pornography, or threaten anyone’s health or safety, any act violating consumer protection laws, or violating privacy.

Our Products may not be used by any person or entity. This includes anyone involved in, or suspected of, illegal gambling. It also includes terrorism, narcotics and arms trafficking, and work involving nuclear, chemical, or biological weapons. This includes weapons of mass destruction or missiles. It includes support for these activities or causes, and affiliations with others who support them.

Unauthorized use of Electro Battery Inc. property

We prohibit the impersonation of Electro Battery Inc., the representation of a significant business relationship with Electro Battery Inc., or ownership of any Electro Battery Inc. property (including our Products and brand) for the purpose of fraudulently gaining service, custom, patronage, or user trust.

About this policy

This policy outlines a non-exclusive list of activities and intent we deem unacceptable and incompatible with our brand.

We reserve the right to modify this policy at any time by publishing the revised version on our website. The revised version will be effective from the earlier of:

the date the customer uses our Products after we publish the revised version on our website; or
30 days after we publish the revised version on our website.
